MINUTES OF A SPECIAL CALLED MEETING OF THE

GILCHRIST COUNTY BOARD OF COUNTY COMMISSIONERS

HELD AUGUST 17, 1992



The Gilchrist County Board of County Commissioners, in and for Gilchrist County, Florida, convened in a special session August l7, l992 at 7:30 P.M., in the Commissioner's Meeting Room at the Courthouse in Trenton, Florida. The following members were present to-wit:

Addy Jones

W. B. Mathis, Jr.

Emory Philman

Fred Wilkerson



Other persons in attendance were Jackie R. Barron, Ex-Officio Clerk; Deputy Clerks Glenda Patterson, Kelly Johnson and Sherree Pitzarell. Steve Bivens, Waccasassa Volunteer Fire Department was present along with other members of the department and spoke on their behalf.



Invocation was provided by Mr. Barron. The Pledge of Allegiance followed.



Agenda Changes-Additions or Deletions



Items added to the agenda for discussion were workshop dates for budget meetings, Waccasassa Volunteer Fire Department and discussion of MSTU millage.



Steve Bivens, Waccasassa Volunteer Fire Dept.



Mr. Bivens addressed the Board concerning the fire department's need to purchase a truck. One has been located at the State's Surplus Property Warehouse in Starke at a cost of $3,200. Request was being made that the County fund this purchase taking this amount out of Waccasassa's budget over a two year period. Mr. Barron stated there is remaining in their budget for this fiscal year approximately $2,200 with additional expenses to be

incurred.



Motion was made by Commissioner Jones, seconded by Commissioner Wilkerson and unanimously agreed to authorizing the purchase of a truck by the Waccasassa Volunteer Fire Dept. from the Starke Surplus Warehouse at a cost of $3,200. Funding for this purchase will be deducted from the amount budgeted Waccasassa Fire Dept. during the next two fiscal years.



Action Amending MSTU Millage Rate



Discussion regarding former action of the Board reducing the Municipal Service Taxing Unit Millage Rate followed. Concern was expressed by those members of the public present encouraging the Board to take action rescinding their former decision decreasing the millage rate. Mr. Blackwell, Town of Bell City Manager, spoke voicing his concern with fire departments throughout the county not having proper and necessary equipment already and does not feel any action should be taken that would decrease fire monies that can be made available. He recommended the county take action to have a fire coordinator.



Mr. Burt and Mr. Barron reviewed with Commissioners legal requirements to be met should they decide to rescind their former action. Motion was made by Commissioner Wilkerson amending the Board's former action reducing the MSTU millage rate from .5 mills to .2 mills thus placing the MSTU millage rate at .5 mills. Commissioner Jones seconded the motion which carried by majority vote. Commissioner Mathis voted no.







Ordinance No. 92-05-A-Imposing a Discretionary Sales Surtax

of One Percent



Mr. Burt introduced proposed ordinace imposing and levying a discretionary sales surtax of one percent.



After intensive deliberation and discussion, the Board took action to adopt Ordinance No. 92-05-A by motion of Commissioner Jones. Motion was seconded by Commissioner Wilkerson and unanimously agreed to.



AN ORDINANCE IMPOSING AND LEVYING A DISCRETIONARY SALES SURTAX

OF ONE PERCENT (1%) TO GENERATE REVENUES FOR OPERATING
PURPOES; PROVIDING FOR DISTRIBTUION OF THE PROCEEDS AMONG THE COUNTY AND Y; PROVIDING FOR AN EFFECTIVE
DATE FOR IMPLEMENTATION OF THE SURTAX; PROVIDING FOR
SEVERABILITY; ESTABLISHING AN EFFECTIVE DATE



WHEREAS, the Florida Legislature amended Section 2l2.055, Florida Statutes, so as to allow small counties to impose a sales surtax from which revenues generated are to be expended for operating purposes, and



WHEREAS, the proceeds and any interest accrued thereto may be used for operational expenses of any infrastructure or for any public purpose, and



WHEREAS, the surtax is to be distributed among the county and the municipalities, and



WHEREAS, the Board of County Commissioners of Gilchrist County deem that it is in the best public interest of the residents of the County that additional revenues be raised for the purposes hereinafter set forth,



NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners in and for Gilchrist County, Florida, as follows:



l. There is hereby imposed in Gilchrist County a small county surtax as authorized by Section 2l2.055 (3), Florida Statutes, levied in the amount of one percent (l%) to take effect on the lst day of October, l992, or as soon thereafter as may be allowed by law.



2. The small county surtax shall remain in effect from year to year for so long as authorized by statute unless otherwise amended by ordinance of the Board of County Commissioners.



3. The proceeds of the surtax levied under this ordinance shall be distributed to the county and the municipalities within the county according to the formula provided in Section 2l8.62, Florida Statutes.



4. The proceeds of the surtax levied and any interest accrued thereto shall be used for operational expenses of any infrastructure or for any public purpose, including, but not limited to the following:



A. Administrative and operational costs of the County.



B. Funding, or partial funding, of the constitutional offices of the County.



C. Funding, or partial funding, of capital improvements and operational expenses of the transportation department.



D. Funding, or partial funding, of the County correctional department.



5. Taxable transactions shall be as provided in Florida Statutes.



6. Should any article, section, paragraph, sentence, clause, phrase, or other part of this ordinance be declared by a court of competent jurisdiction to be invalid, such a decision shall not afect the validity of the ordinance as a whole.



7. This ordinance shall take effect upon receipt of official acknowledgment of the Secretary of State of the State of Florida that this ordinance has been filed in his office.

Proposed Ordinance Imposing a One Cent Gas Tax



Commissioners discussed proposed ordinance approving a one cent gas tax the revenues of which will be used in the Transportation Department. There being no person present opposing the proposed ordinance, motion was made for adoption by Commissioner Jones, seconded by Commissioner Philman and unanimously agreed to as follows.



ORDINANCE IMPOSING A ONE CENT GAS TAX



AN ORDINANCE IMPOSING A ONE CENT GAS TAX THE REVENUES FROM
WHICH SHALL BE USED TO PAY TOWARDS THE COSTS AND EXPENSES OF OPERATING AND MAINTAINING A TRANSPORTATION SYSTEM AND THE COST OF ACQUISITION, CONSTRUCTION, RECONSTRUCTION, AND MAINTENANCE OF ROADS AND STREETS; PROVIDING FOR A DATE OF IMPOSITION OF THE GAS TAX; PROVIDING FOR SEVERABILITY; ESTABLISHING AND EFFECTIVE DATE.



WHEREAS, the Florida Legislature amended Section 336.02l, Florida Statutes, so as to allow small counties to impose a one cent gas tax to be collected and remitted by any person engaged in selling at retail motor fuel or using or selling at retail special fuel within Gilchrist County which shall be distributed monthly by the Department of Revenue to Gilchrist County, as otherwise provided in Section 336.02l(l)(2), Florida Statutes.



WHEREAS, the purposes of the revenues to be applied toward the costs and expenses of establishing, operating, and maintaining a transportation system and related facilities and the cost of acquisition, construction, reconstruction and maintenance of roads and streets in Gilchrist County, and



WHEREAS, the Board of County Commissioners of Gilchrist County deems that it is in the best public interest of the residents of the County that additional revenues be raised for the purposes hereinafter set forth,



NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners in and for Gilchrist County, Florida as follows:



l. There is hereby imposed in Gilchrist County a one cent gas tax as authorized by Section 336.02l, Florida Statutes, levied in the amount of one cent to take effect on the lst day of October, l992, or as soon thereafter as may be allowed by law.



2. The gas tax shall remain in effect from year to year for so long as authorized by statute unless otherwise amended by ordinance of the Board of County Commissioners.



3. The proceeds of the gas tax levied under this ordinance shall not be used for the purpose of servicing bond indebtedness.



4. The proceeds of the gas tax levied and any interest accrued thereto shall be used for the following purposes:



Costs and expenses of establishing, operating, and maintaining a transportation system and related facilities and the cost of acquisition, construction, reconstruction and maintenance of roads and streets in Gilchrist County.



5. Taxable transactions shall be as provided in Florida Statutes.



6. The Clerk to the Board is hereby authorized and directed to notify the Department of Revenue within ten (l0) days after enactment of this Ordinance that the governing body of the County has adopted the ordinance.



7. Should any article, section, paragraph, sentence, clause, phrase, or other part of this ordinance be declared by a court of competent jurisdiction to be invalid, such a decision shall not affect the validity of the ordinance as a whole.



8. This ordinance shall take effect upon receipt of official acknowledgement of the Secretary of State of the State of Florida that this ordinance has been filed in his office.

Public Defender's Office Lease



Proposal of a 2 year extension to the present lease for the Public Defender's Office located in Bronson was noted as having been received. Commissioners agreed to take this up at a future date during the budget process.



Opening of Bids-County Jail Renovation & Construction of

Administration Building/EMS Facility



Bids were opened and publicly read aloud as follows for building materials to be used in the above described project.



Gilchrist Building Supply $l4,355.22

Overstreet Building Supply $l4,800.95



Motion was made by Commissioner Philman to award the bid to Gilchrist Building Supply as being the lowest bid received. Commissioner Mathis seconded the motion which carried unanimously.



Quotes on Roof Trusses



Written quotes were presented by Albert Martin, Contractor, on roof trusses needed for construction of the administration/EMS facility at the county jail site. Quotes were received from Anderson Truss Company in Lake City for $5,240 and from Florida Roof Truss Company in Ocala in the amount of $5,230.23. Mr. Martin commented Anderson was the only firm from which he received a quote who was willing to provide an engineering certificate without first being told they would receive the business. Based on recommendation of Mr. Burt,motion was made by Commissioner Mathis to approve the purchase from Anderson Truss Company, seconded by Commissioner Jones and agreed to.



Authorization to Construct Concrete Apron Adjacent to County

Maintenance Barn



Mr. Martin stated he had been requested by Mr. Joyner to approach the Board on having a concrete apron poured adjacent to the county maintenance barn using inmate labor. Motion was made approving this request by Commissioner Wilkerson, seconded by Commissioner Jones and agreed to.



Resolution 92-13



Motion was made by Commissioner Jones, seconded by Commissioner Mathis and agreed to adopting the following Resolution.



WHEREAS, the Gilchrist County Board of County Commissioners acknowledge the availability of Emergency Medical Services Trust-Fund monies; and



WHEREAS, the grant of said trust-fund monies available to the County in the amount of $2,222.l4;



NOW, THEREFORE, be it RESOLVED by the Board of County Commissioners of Gilchrist County, Florida that the Gilchrist County Board of County Commissioners does hereby accept the Emergency Medical Services Trust-Fund monies granted to the County in the amount of $2,222.l4, and further be it RESOLVED the grant so accepted shall be earmarked and used soley for improvement and expansion of the Gilchrist County pre-hospital emergency medical service.



RESOLVED in regular session this the l7th day of August, l992.

Commissioners agreed to hold a budget workshop September 2nd and September l0th at 9:00 A.M.



There being no other business to come before the Board,motion was made by Commissioner Wilkerson to adjourn at ll:05 P.M., seconded by Commissioner Mathis and the meeting adjourned.
